Working With H3
Terms of Service
The terms that apply to our quoted maintenance work and to using this website.
Customer Terms and Conditions
1. Contracting party and services
“H3” means H3 Property Works. “Client” means the person or organisation accepting an authorised quotation. Services may include the property-maintenance activities listed in the quotation. Specialist or regulated work will be undertaken only by appropriately competent or legally authorised persons where required.
2. Enquiries, inspections and quotations
Website enquiries are requests for information, not confirmed bookings or fixed-price offers. We may assess the site before quoting. Each quotation should identify scope, materials, exclusions, estimated timings, applicable VAT status, call-out/diagnostic charges (if any), deposit, payment schedule and quotation validity. A quotation is valid for the stated period only. No chargeable diagnostic service, repair or variation will be performed without the authorisation required by applicable law.
3. Acceptance and commencement
A binding job agreement is formed only when H3 confirms acceptance of the particular scope, price and applicable terms through a signed quote, email, recorded message or other legally effective process. The client confirms that they own the premises or have authority to instruct the work. Work may be scheduled subject to deposit/payment arrangements expressly agreed for that job.
4. Scope and exclusions
Only items expressly described in the accepted quote are included. Unless specifically included, hidden damage, asbestos or hazardous-material handling, structural engineering, permit applications, extensive making-good, painting after concealed repairs, waste disposal, certificates and third-party works are excluded. H3 must not imply it can perform regulated activities for which required registrations or competency have not been verified.
5. Variations and latent conditions
If an unexpected defect or condition is discovered, H3 will stop the affected non-emergency work as reasonably practicable, explain the condition, and obtain approval for a written price/time variation before undertaking additional chargeable work. If immediate action is reasonably needed to prevent imminent harm, H3 will seek instruction as soon as practicable and record the basis for any emergency steps; statutory authorisation requirements remain applicable.
6. Access, cooperation and site safety
The client must provide lawful and reasonably safe access, disclose known hazards, ensure required permissions or landlord/estate approvals are obtained where allocated in the quote, and secure animals and movable valuables. H3 will take reasonable care and follow applicable occupational health and safety obligations; H3 may suspend unsafe work while notifying the client. Access or utility constraints may require a mutually agreed revision.
7. Timelines and unavoidable delays
Start and completion dates stated as estimates are subject to the confirmed job terms. H3 will notify the client of material or unavoidable delays promptly, explain the impact and work reasonably to agree revised dates. We will not use a blanket exclusion to avoid liability for delays or poor performance where consumer law provides a remedy.
8. Prices and payment
The accepted quote must clearly indicate price, VAT treatment, material and labour charges, call-out fees, payment milestones and any deposit. H3 will invoice according to the agreed schedule. Any late-payment interest, collection charge or suspension right must be lawful, reasonable and explicitly agreed in advance; no rate is assumed by this draft. Clients should verify bank details using an independently known H3 number before payment.
9. Client-supplied items and third parties
If the client supplies materials, H3 will explain any reasonably identifiable compatibility or safety concerns. H3 remains responsible for its own work to the extent required by law, but does not automatically guarantee the inherent quality of goods it did not supply. Work by other contractors remains their responsibility, without removing any H3 liability imposed by law.
10. Quality and consumer rights
H3 aims to perform work with reasonable skill, care and timely communication. Consumers protected by the Consumer Protection Act retain applicable rights under sections 54–57 and elsewhere, including remedies for poor-quality services and applicable goods/repair warranties. No limitation or exclusion in these Terms overrides non-excludable rights.
11. Defects and handover
At completion, H3 and the client should record completed work, any agreed outstanding items and supporting photos where appropriate. The client should notify H3 promptly of problems so they can be investigated. A late report does not automatically extinguish a statutory claim. The separate Warranty Policy describes the assessment and remedy process.
12. Cancellations and refunds
Advance bookings may be cancelled in accordance with the Cancellation and Refund Policy and applicable law. Charges, if any, must be reasonable and demonstrable; deposits are not automatically forfeited. Work already properly performed and specially ordered materials will be accounted for lawfully. Rights arising from direct marketing or qualifying electronic transactions are preserved.
13. Property images and confidentiality
H3 may take reasonable job photographs for quotes, quality control, safety, evidence and disputes. Use of identifiable property imagery, names or testimonials for public marketing requires a separate lawful basis and appropriate permission. We will not publish private addresses or access details.
14. Liability and disputes
Each party remains liable as determined by applicable law. Nothing excludes liability for fraud, gross negligence, injury or other loss where exclusion is prohibited, or removes CPA remedies. Complaints should be sent to info@h3propertyworks.co.za; parties should first attempt reasonable resolution before proceeding through lawful ombud, regulator or court channels. South African law governs, subject to mandatory rights.
15. Priority of documents and amendments
The signed quote/work order takes priority on job-specific scope, price and timing; mandatory legislation takes priority over all terms. Changes to scope or price must be approved and recorded. Material amendments to an accepted contract require the parties’ agreement rather than unilateral website changes.
Website Terms of Use
1. Information only
Website content describes services generally and may change. It is not a binding quotation, technical inspection, engineering opinion or guarantee that a requested service is available on a particular date.
2. Enquiries
Sending a form, email or WhatsApp enquiry does not create a contract or guarantee a response time. We may request additional information to provide a quote.
3. Acceptable use
You may not misuse forms, upload malicious content, interfere with the website, infringe rights or misrepresent your identity or authority.
4. Intellectual property
Unless indicated otherwise, H3 owns or licenses its website text, logo, visual assets and site design. You may view them for personal informational use, but may not reproduce them commercially without permission.
5. Third-party services
External maps, messaging services, social-media links and other sites are operated by their providers. Their own privacy terms may apply.
6. Website availability and legal rights
We take reasonable care with the website but cannot warrant uninterrupted availability. Nothing here excludes rights or liability that may not lawfully be excluded. South African law applies.
7. Contact and updates
Questions: info@h3propertyworks.co.za. These terms may change prospectively; accepted service agreements do not change merely because website wording changes.
